Gobierno Duque pidió anular fallo que despenalizó el aborto hasta la semana 24 en Colombia

La despenalización del aborto en Colombia hasta la semana 24 estaría en peligro luego de la petición que le hizo el Ministerio de Justicia a la Corte Constitucional. La cartera cuestionó el fallo proferido en febrero de este año, con el que se despenalizó la interrupción voluntaria del embarazo hasta el tiempo mencionado.

El Ministerio de Justicia alegó que en este caso ya había cosa juzgada, refiriéndose al fallo del 2006, cuando se aprobó el aborto bajo tres causales: cuando existe peligro para la salud física o mental de la mujer; cuando exista grave malformación del feto que haga inviable su vida extrauterina; en caso de acceso carnal violento, transferencia de óvulo fecundado o inseminación artificial no consentida.

De acuerdo con la cartera, en la aprobación de la despenalización del aborto hasta la semana 24 de gestación, se habrían presentado algunas irregularidades. Así mismo, el documento emitido por MinJusticia señala que ninguna instancia nacional o internacional puede definir cuál vida proteger y cuál no.

“No existe bien superior más importante que la vida humana que es el fundamento de todos los demás derechos, por lo que ni siquiera un tribunal judicial, internacional o nacional, puede arrogarse el derecho para determinar desde cuándo una vida merece protección constitucional per se”, dice el documento citado por Noticentro 1 CM&.

El Gobierno de Iván Duque además mencionó las presuntas irregularidades en el proceso previo a emitir la Sentencia C-055 de 2022. De acuerdo con el documento enviado a la Corte Constitucional, las animalias se dieron en el estudio de dos ponencias presentadas por los magistrados Antonio José Lizarazo y Alberto Rojas.

Así mismo, se menciona el salvamento de voto que hizo el magistrado Jorge Enrique Ibáñez en su momento, debido a las anomalías en el proceso de deliberación y expedición de la sentencia que se emitió en febrero de este año.

“Esta cartera ministerial, encuentra totalmente fundamentada la postura expuesta y debidamente sustentada por el Dr. Jorge Enrique Ibáñez Najar, quien se aparta de la decisión mayoritaria del máximo órgano de la jurisdicción constitucional con fundamento en las irregularidades advertidas en el proceso de deliberación y expedición de la Sentencia C-055 de 2022″, señaló el MinJusticia.

Tras haberse solucionado el tema del aborto en Colombia, con la histórica sentencia de febrero de 2022, el Gobierno nacional reabre la discusión y señala que debe ser el poder ejecutivo quien tome las decisiones sobre este tema.

“Por competencia, le corresponde al legislativo y ejecutivo proyectar, definir y desarrollar políticas públicas que hagan eficaz las decisiones de la Corte Constitucional. No amerita una nueva decisión en sede de revisión constitucional”, dice una de las solicitudes de nulidad de la sentencia.

Así mismo, respaldó las peticiones de 20 ciudadanos de anular la sentencia y le solicitó a la Corte Constitucional darle celeridad a estas solicitudes de los colombianos que no están de acuerdo con la despenalización de la interrupción voluntaria del embarazo hasta la semana 24.
